Terms and Conditions of the 2023 Rugby World Cup Final MasterCard VIP Package Contest 
Welcome to the 2023 Rugby World Cup Final MasterCard VIP package Contest.
During the Contest (as defined below), the Participants will be required to register for the Content, Answer to the Contest Question and Send the Answer – all during the Contest Period. 
Participation in the Contest is subject to these Terms and Conditions ("Terms"). The Participants will be able to take part in the Contest, subject to the Participant's agreement to the Term and to the Organizer's privacy policy (available on https://www.telavivheat.com/privacypolicy) ("Privacy Policy"); by registering for the Contest and/or participating in the Contest (including by Answer to the Contest Question and Sending the Answer) you approve all these Terms and the Privacy Policy and agree to be bound and comply with it.
1.    Definitions
1.1.    "Contest" – the 2023 Rugby World Cup Final MasterCard VIP package contest activity, organized by Tel Aviv Heat Rugby Ltd, where the Participants are required to answer the Question. 
1.2.    "Contest Period" - starting from July 10th, 2023 at 12:00 noon IST (start date of the Contest) until September 29 2023 at 12:00 noon IST (end date of the Contest). This period is subject to the Organizer's discretion, which may change the start and/or end date of the Contest, including extending, shortening, or interrupting the period of the Contest without prior notice, and at its discretion. 
1.3.    "Contest Judges" - Representatives on behalf of the Organizer, whose number and identity shall be determined by the Organizer, in accordance with its discretion. The Organizer reserves the right to change the identity of such judges or their number.
1.4.    "Contest Webpage" - A dedicated webpage at https://www.telavivheat.com/rwc-contest ("Organizer Website"), which will be available during the Contest Period and through which the Participants will be able to participate in the Contest, as detailed hereunder. 
1.5.    "Participant" and/or "Participants" – an adult (i.e. over the age of 18 or at an older age, as required under the relevant law applicable to the relevant Participant) who meet all the terms of these Terms, including as detailed in section 4.1 below.  
1.6.    "Participant Information" - The requested details of the Participant in the Contest, accurate, complete, and correct, including first and last name, email address, telephone number, and/or cell phone number; 
1.7.    "Prize" - as defined in Section 6 below. The Organizer and/or the Prize Sponsor reserves the right to change or replace the Prize, from time to time, and/or the value of the Prize, all at their discretion.
1.8.    "Prize Sponsor" – Mastercard Europe SA, which is the sponsor of the Prize and of the Rugby World Cup 2023 Final Match ("Event"). 
1.9.    "Organizer" - Tel Aviv Heat Rugby Ltd. 
1.10.    "Contest Question"; "Answer to the Contest Question" and; "Sending the Answer"- each as respectably defined in Section ‎6.1 below. 
1.11.    "Winner" - The Participant who shall be announced by the Contest Judges (in a place and a way to their decision) as the Participant who is entitled to be the winner and to win the Prize, all after being located and proven by him that he meets the conditions of eligibility for the Prize, in accordance with the condition hereunder. 
2.    Interpretation and  General
2.1.    The introduction to these Terms and the definitions therein informing an integral part thereof. In any case of any contradiction and/or inconsistency between the provisions of these Terms and any other publications regarding the Contest, including in the Website and/or the Contest Webpage and/or e-mails, the provisions of these Terms shall prevail. 
2.2.    The headings of the Sections in these Terms are for the purpose of ease of reading only, and should not be given any meaning for the purpose of understanding and/or interpretation. 
2.3.    The purpose of the Terms is to regulate and determine the rules according to which the Contest will be conducted and it constitutes a valid agreement between each of the Participants and the Organizer. 
2.4.    The Organizer may during the Contest Period, amend, change, and/or update the Terms and the Privacy Policy, at its discretion. The updated Terms and Privacy Policy will be available on the Organizer Website and will be the binding and determining version.
3.    Conditions of Participation in the Contest
3.1.    A Participant in the Contest will be anyone who is during his participation is:
3.1.1.    an adult (i.e. over the age of 18 or at an older age, as required under the relevant law applicable to the relevant Participant); 
3.1.2.    purchased during the Contest Period a membership of Tel-Aviv Heat Rugby from the Organizer, and received an identifying membership number ("Identifying Membership Number"). 
3.1.3.    provided at the  Contest Webpage all the accurate and correct required Participant Information;
3.1.4.    registered to the Contest in accordance with the instructions of the Organizer;
3.1.5.    Answered the Contest Question and Sending the Answer.
3.1.6.    Comply with all provisions of these Terms.
3.2.    For the avoidance of doubt, it is clarified that participating in the Contest, Sending the Answer, and providing Participant Information as required, in an accurate and complete manner, are solely the responsibility of the Participant. The Organizer will have no responsibility regarding incorrectness and/or inaccuracy and/or disruption of the Answer and/or the Participant Information sent or answered as part of the Contest.
4.    Participant in the Contest, Conducting the Contest and its results
4.1.    Each Participant (who is entitled to participate in the Contest), is welcome to enter the Contest Webpage, enter the Participant Information, and answer (according to the terms, limitations, and conditions detailed in this Term, including in this section below)  question "Tell us why you deserve to win the amazing prize" (or any other similar question, as shall be set by the Organizer) (respectably, the "Contest Question" and the "Answer to the Contest Question"), followed by sending it's the Contest Question by sending an e-mail to   RWC-competition@telavivheat.com ("Sending the Answer").
Please note that The Answer to the Contest Question may be submitted by one of the following alternatives only: (1) a written answer, provided however that it shall not exceed the maximum limit of a half A4 page; or (2) one painting, provided however that it shall not exceed the maximum limit of a half A4 page; or (3) a filmed answer (maybe a song or oral answer) provided however that it shall not exceed the maximum limit of one minute. 
By Answering the Contest Question, Sending the Answer, and/or providing the Participant Information, the Participant warrants, agrees, and undertakes as follows:
4.1.1.    He has carefully read the provisions of these Terms and he approves all the provisions of these Terms and agrees to be bound and comply with all of them (including any amendments, changes, and/or updates the Organizer may include in the Terms).
4.1.2.    His Answer to the Contest Question shall be an original answer, which is an original creation by him, and that such Answer to the Contest Question (or its presentation in the plural) do not and shall not infringe upon, misappropriate, or violate any intellectual property rights, including copyright, patent, trademark, trade secret or other proprietary right of any person or other legal entity.
4.1.3.    His Answer to the Contest Question will not contain racist, offensive, vulgar, innuendo or content of a sexual nature, defamation, private or personal information of a person other than the Participant Sending the Answer and/or any statement and/or wording that may: harm any third party or the public feelings or emotions; embarrass or harm the readers of the Answer to the Contest or any other third party and/or the public; infringe any third party's rights, in Israel or abroad, including copyrights and trademarks and/or otherwise violate the provisions of the apolitical laws. 
4.1.4.    The use of the Contest Webpage, answering the Contest Question, Sending the Answer and/or providing the Participant Information and participation in the Contest shall be at the Participant's responsibility and he has received the consent and/or approval of any third party required for this purpose and he undertakes to indemnify Organizer, its employees, its managers or anyone on its behalf for any damage, loss, loss of profit, payment or expense incurred by the Participant, including attorney's fees and court costs, for any claim and/or demand raised against the Organizer by any third party in connection with the Answer to the Contest Question and/or the use the Organizer will make of it.
4.1.5.    All rights, titles, and interests as well as any intellectual property rights, in and to the Participant Answer to the Contest Question shall be owned solely and exclusively by the Organizer, as of the creation of such Answer to the Contest Question. 
4.1.6.    The Participant hereby irrevocably grants the  Organizer a fully paid-up, royalty-free, exclusive, sublicensable, worldwide, perpetual license to use: (1) his Answer to the Contest Question, and any modification thereto; and (2) the Participant Information and his image, likeness, name and/or nickname – all as Organizer deems fit and for its own purposes, which shall include without limitation commercial use, make derivative work, reproduction, and distribution on any media, including on social media (organic and sponsored), advertising, performance marketing, promotion, etc.. It is clarified that the Organizer shall have no obligation to perform any use of the Answer to the Contest Question and/or of the Participant Information, image, likeness, name, and/or nickname and such use shall be made at the Organizer's discretion. 
4.2.    The Organizer is the sole and exclusive organizer of the Contest.
4.3.    For the purpose of determining the Winner, following the end of the Contest Period, the winning Answer to the Contest Question, shall be the Answer to the Contest Question announced by the Contest Judges, in accordance with their consideration, as the most creative and convincing. The eligibility of the Participant who sends the abovementioned Answer to the Contest Question to win will be checked, in accordance with the provisions of these Terms.
4.4.    The Organizer shall be entitled, at its discretion, to disqualify a Participant for a Prize and/or a Winner, and in such case, the Organizer may (but in no event shall be obligated to) select an alternative Winner who meets the eligibility conditions for participation in the Contest and comply with the provisions of these Terms.  For the avoidance of doubt, the winning of a Winner who did not meet the eligibility conditions for participation in the Contest and/or for receiving the Prize and/or did not comply with the provisions of these Terms ("Invalid Winner") will be void for all intents and purposes and the Invalid Winner will not be entitled to any other Prize and/or compensation and/or indemnification from the Organizer.
4.5.    Without derogating from the provisions of these Terms and the provisions of any law, the Organizer shall be entitled to cancel the winning of the Prize, in whole or in part, to cancel the Contest, in whole or in part, and to cancel participant of any of the Participants the at the sole discretion of the Organizer, and the Participant or Participants, including the winning candidates and/or Winners, shall not have any claim and/or claim and/or demand in connection therewith.
5.    The Prizes
5.1.    At the end of the Contest Period, one Winner will be chosen as the Winner, according to the provisions of these Terms who will win the Prize detailed under Appendix A to these Terms ("the Prize"). The Prize is at the sole discretion of the Organizer and the Organizer may change or replace it at any time and the Participants, including the Winner, will not have any claim and/or demand in connection with the aforementioned. 
5.2.    It is hereby clarified and agreed that the Prize awarded is limited to 1 (one) Prize and that not all Participants in the Contest will be entitled to the Prize. The Participants confirm and undertake that they will be prevented from raising any claim and/or claim and/or demand against the Organizer in connection therewith.
5.3.    The description of the Prize in these Terms and/or in any other publication of the Organizer is for illustrative purposes only, and it does not bind the Organizer and/or anyone on their behalf. 
5.4.    The Winner acknowledges that the entitlement to Prizes is personal, and cannot be transferred to any other person; and that the Prize is for personal usage and in any event, he may not use the Prize in any commercial way or form. 
5.5.    The Winner has no possibility to convert, exchange, redeem, and/or change in any way the Prize he won, neither in money nor in money equivalent nor in any other Prize or product, and no amount whatsoever will be refunded for the Prizes.
5.6.    The Organizer and the Prize Sponsor will not be responsible for the Prize, any of the terms and limitations and/or law which may apply to it, and for any damage, directly and/or indirectly, that may be caused to the Winner and/or someone on his behalf, and/or to any third party in connection with the Prize and/or its realization, including the nature of the Prize and/or its delivery and/or to the conditions and/or to the dates in which they will be provided and/or to the results of its implementation and/or damages due to cancellation, change of date and/or change of location of any part of the Prize. The Winner will not have any claim and/or demand against the Organizer and the Prize Sponsor for any damage and/or expense and/or loss that any of them will cause directly and/or indirectly in connection with the Prize and/or its realization or inability of realization for any reason. 
5.7.    Without derogation from Section 5 above, it is clarified and agreed that in any event of cancellation, change of date, and/or change of location of any part of the Prize, the Organizer may be entitled (but not obligated to) to update or replace the Prize in accordance of such cancellation, change of date and/or change of location or cancel the Prize (without alternative Prize), at its sole discretion. 
5.8.    Any expense, tax, levy, or fee, of any kind and type, in connection with the Prize and/or Contest, that may be razed or applied according to the applicable law, will apply to the Participants and Winner only and will be at their expense and sole responsibility, and the Organizer will not bear any such expense and/or payment and/or levy, etc., including taxes, from the Prize, and they will apply to the Winner only.
5.9.    The Organizer may require the winning candidate to transfer the payment of any tax applicable to him in respect of the Prize at a date announced by the Organizer, at its discretion. If the winning candidate shall not pay such tax, the Prize shall not be given to him, and the winning candidate shall not have any claim and/or claim and/or demand in connection therewith.
5.10.    For the avoidance of doubt, it is clarified that even if the Prize will not be distributed or realized, due to the fact that it was not required and/or a winning candidate or Winner did not meet one of the conditions for winning (including in the event of an Invalid Winner) and/or the Prize was not claimed, in whole or in part and/or the provisions of these Terms and/or a winning candidate or Winner was canceled and/or a candidate for winning or a Winner renounced his winning, by act or omission, the Organizer may, at its sole discretion, conduct an additional Contest for the purpose of distributing the said Prizes, all or part of them. Any Participant for a win or Winner who did not claim a Prize did not meet the conditions for winning and/or the provisions of the regulations, whose win was canceled and/or who waived a Prize, and/or any participant, shall be precluded from raising any claim and/or claim and/or demand against the Organizer.
5.11.    For the purpose of distributing the Prize to the Winner, the Organizer will contact the Winner using one or more of the Participant Information, in a manner and at a time determined by the Organizer. If following 3 (three) attempts to contact the Winner, the Organizer is unable to locate the Winner, the Winner's winning shall be invalidated and void and the Organizer will be entitled (but not obliged) to choose an alternative Winner according to these Terms. The Organizer does not guarantee that the winning confirmation date will be on a date and/or time suitable for the Winner.
5.12.    As a condition for receiving the Prize, the Winner shall be obligated to present to the Organizer its identification card and identifying Membership Number and to sign the approval of receiving the Prize in the version attached as Appendix B to these Terms. 
5.13.    It is clarified that the Organizer will be entitled to condition the distribution of the Prize on additional conditions.
5.14.    The delivery of the prize will be done in a manner and at a time determined by the organizer of the promotion.
6.    Miscellaneous
6.1.    The following are excluded from participating in the Contest:
(i)    any employee of Organizer and its relatives, Prize Sponsor and its relatives, and employees and relatives of any third-party agency contracted by Organizer or Prize Sponsor to execute any part of the Contest who (a) participated in any phase of Contest (definition, design, development, approval or execution); and/or (b) has or had access to confidential or privileged information about any phase of Contest (definition, design, development, approval or execution); 
(ii)    Organizer’s Executive Management; and
(iii)    Organizer´s employees in the marketing and credit cards (including its Information Area) who have the authority to make or ability to influence business decisions.
6.2.    Each Identifying Membership Number (received following the purchase of a membership of Tel-Aviv Heat Rugby from the Organizer during the Contest Period) shall grant the Participant the right to participate 1 (one) time in the Contest (for example, the Participant who purchased 2 Identifying Membership Numbers during the  Contest Period will be able to participate twice in the Contest) 
6.3.    In any case of misunderstanding, doubt, or difficulty, including in the interpretation of the Terms in relation to the Contest, it will be the Organizer's decision that shall prevail.  
6.4.    The participation in the contest of a Participant who cancels purchases and/or returns the purchase and/or does not pay for a purchase that enables him to participate in the Contest, will be terminated and he will be required to return the Prize (to the extent that he was the Winner).
6.5.    Without derogating from any other term in these Terms, the Organizer will decide, at its sole discretion and without the need for reasoning, regarding eligibility for the Prize, in any case where there is a suspicion that there has been a defect and/or a lack of clarity in the process and/or in determining the winning candidate and/or the Winner, and also, for any other reason related to an offense against the law or any other relevant reason (including violation of the provisions of the Terms.
6.6.    The results of the Contest as determined by the Organizer (by the Contest Judges) and the Organizer's decisions on any subject and matter, will be final and cannot be appealed, and will be binding on the Participants.
6.7.     For the avoidance of doubt, it is clarified that the Organizer reserves the right to cancel the Contest (in whole or in part) and/or to change the conditions of the Contest, and/or change the Contest dates, and/or to postpone, extend or shorten the Contest Period or other dates, and/or to change the Prize, and all at its sole discretion, including but not limited to, in the event that it turns out that there has been a malfunction, disruption, prevention or interference that prevents the Participants from participating in the Contest, or due to constraints that do not depend on the Organizer and/or for any other reason.
6.8.     Each Participant agrees that in any case where a cancellation or change as mentioned under these Terms, the Participant would not have any claim and/or demand in connection with this cancellation or change against the Organizer. The Organizer will publish the cancellation or change in any way it deems appropriate. For the removal of doubt, it is clarified that making any such cancellation and/or change will be seen as an addition and/or change to the Terms that will bind the participants.
6.9.     Participation in the Contest is the sole responsibility of each Participant, The Organizer will not be responsible for any event and/or damage and/or expense and/or loss caused to the Participants and/or anyone on their behalf, and the Participants will not have any claim and/or a demand towards the Organizer in all that is related, directly or indirectly to the Contest and/or its results and/or its implementation and/or the Prize.
6.10.     The Participant declares that he knows that participation in the Contest is subject to the availability and the proper operation of the Website and the Internet systems. The Organizer will not be responsible for the proper operation of the Website and/or the Internet systems and will not be held responsible for any interruptions and/or malfunctions of the Website or the Internet systems and/or for any damages, direct or indirect, including direct or indirect expenses, that will be caused to the participants as part of the Contest due to such interruptions and/or interruptions. In the event of such a malfunction, the Organizer will be entitled, in accordance with its sole discretion, to cancel the Contest and/or change its dates, as well as to take any other action it deems appropriate, all without granting and/or entitle the Participants any right to raise against the Organizer and/or anyone on its behalf any claim and/ or a claim and/or demand for damage caused due to an error, malfunction, delay, technical or another failure, including failure to receive the personal details and/or his results in the Contest and/or preventing his participation in the Contest.
6.11.    Despite the Organizer's efforts, mistakes and/or disruptions and/or interruptions and/or faults may occur, including disruptions in communication, computing, and Internet systems, as stated in section 7.7 above, at any stage of the Contest stages, for any reason, including, but not limited to, human mistake. By participating in the Contest, each Participant agrees to exempt the Organizer from any claim and/or demand for any event and/or damage and/or expense and/or loss that may be caused to him directly and/or indirectly in connection with the errors and/or disruptions and/or interruptions and/or malfunctions and/or regarding the actions that the Organizer will take, if it chooses to do so at its sole discretion, in connection with these errors and/or disruptions and/or interruptions and/or malfunctions, and will not be entitled to any compensation, indemnification and/or relief.
6.12.    Without detracting from the generality of the above, by participating in the Contest, each Participant agrees that any malfunction, disruption, delay, etc., which originates, among other things, from force majeure, war (including between countries or entities other than Israel), strike, terrorist attacks, natural disasters, and any cancellation or change in the dates of the Contest and/or performance and/r the Prize, which are not dependent on the Organizer and/or the Prize Sponsor, will not be considered a violation of these Terms by the Organizer, and will not entitle the Participant to any remedy and/or right and/or claim and/or demand and/or a claim against the Organizer and/or the Prize Sponsor, and/or someone on their behalf.
6.13.    The Winner is responsible for redeeming the Prize. The Organizer will not be held responsible for disruption, delay, or postponement of the realization, and/or for failure to realize the Prize for reasons beyond their control.
6.14.    The laws of the State of Israel will exclusively apply to these Terms and the Contest; the competent Court in Tel–Aviv–Yaffo only, and no other Court anywhere else, will hold unique and exclusive jurisdiction to hear any matter resulting from these Terms and the Contest or involved in same – all including any issue relating to the Terms and the contest), whether directly or indirectly.

Appendix A
The Prize
(a)    The Winner of the Contest shall be entitled to the Prize which includes all of the following, all subject to the terms and conditions of the Terms :
1.    2 (two) nights’ accommodation for two adults on the dates 27-29/10/2023, in Pullman Paris Eiffel Tower Hotel (accommodation only) or other accommodation to be chosen by the Organizer and/or the Prize Sponsor, at its discretion; and 
2.    Transfer (at a type and level to be chosen by the Organizer and/or the Prize Sponsor) from one of the airports located in Paris, as shall be determined by the Organizer and/or the Prize Sponsor (the "Airport") to the accommodation and from the accommodation to the Airport; and 
3.    Dinner for 2 (two), at a restaurant to be chosen by the Organizer and/or the Prize Sponsor, at its discretion; and
4.    2 (two) Gift bags, with contents to be chosen by the Organizer and/or the Prize Sponsor, at its discretion; and
5.    Transfers from the hotel to the Event stadium and from the Event stadium to the hotel.; and
6.     2 Tickets & and VIP Hospitality to the Event (the Rugby World Cup 2023 Final Match) at Stade de France stadium, Saint-Denis, Paris.  
(b)    For the avoidance of doubt, it is clarified:
1.    The Prize does not include any other component not detailed under Section (a) above. Without derogating from the generality of the above, it is clarified that the Prize does not include (1) flights or other transformations to and/or from the Airport; and (2) any insurance – both to be obtained by the Winner at its responsibility and costs.
2.    The responsibility to check the nature of the prize and how to redeem it rests with the Participants and the Winner.
3.    The Organizer and/or the Prize Sponsor shall not be responsible for the time arrivals to the accommodation or the airport or the Event stadium (as the case may be) and/or for any delay of the transformation.
Arrival at the required time to the airport in time for the Winner's flight is the sole responsibility of the Winner
4.    The Organizer and/or the Prize Sponsor shall not be responsible for the quantity, quality, or nature of the served food and the accommodation.
5.    It is clarified that the Organizer and/or the Prize Sponsor shall not be responsible for the arrival time to the Event stadium or (as the case may be) the Airport and/or for any delay of the transformation. 
6.    It is clarified that the Organizer and/or the Prize Sponsor shall not be responsible for any delay cancelation or any other change with respect to the Event or the Event date.

Appendix B
Prize Receipt Approval
__________, has been announced as the Winner of the 2023 Rugby World Cup Final MasterCard VIP package contest ("Contest"), and awarded the Prize (as detailed under Appendix A to the Term) valued at [___] by the Prize Sponsor. 
I hereby warrant, undertake, acknowledge, and approve: 
(i)    I have a receipt of the Prize.
(ii)    I shall not contact the Pullman Paris Eiffel Tower hotel directly, and for any question, request, or clarification I shall contact Lana Kadim, COO at Tel Aviv Heat (lana@telavivheat.com).
(iii)    I have read the Contest's Terms and Conditions ("Term") published at https://www.telavivheat.com/rwc-contest and the Privacy Policy published at https://www.telavivheat.com/privacypolicy; I agree and accept all of the Term's terms and conditions and to be bound with all of them; and I compiled and will continue to comply with all the Term's terms and conditions.
(iv)    Without derogating from the generality of the above, I approve that I meet all the requirements detailed under the Term in order to be a Participant and to be announced as the Winner of the Contest; I acknowledge that the entitlement to Prizes is personal, and I cannot transfer it to any other person; and that the Prize is for personal usage and in any event, I may not use the Prize in any commercial way or form.
(v)    I acknowledge that have no possibility to convert, exchange, redeem, and/or change in any way the Prize, neither in money nor in money equivalent nor in any other Prize or product, and no amount whatsoever will be refunded for the Prizes. 
(vi)    I acknowledge that the description of the Prize in the Terms and/or in any other publication of the Organizer is for illustrative purposes only, and it does not bind the Organizer and/or anyone on their behalf. 
(vii)    I acknowledge that the receipt of the Prize and its realization is subject to all the applicable terms and limitations including those of the deferent providers of the Prize and the applicable laws, and that the Organizer and the Prize Sponsor shall have no liability or control with respect with the abovementioned.     
(viii)    I will not have any claim and/or demand against the Organizer and the Prize Sponsor with respect to this approval, the Contest, and/or the Prize. 
(ix)    I shall defend, indemnify and hold the Organizer and the Prize Sponsor and its directors, officers, employees, subcontractors, and agents, upon their first demand, harmless from and against any and all damages, liabilities, losses, demands, claims, costs and expenses (including linkage differentials, interest, fines, and reasonable legal fees) arising from or in connection with any of the matters referred elating, directly or indirectly, in whole or in part, from this approval and/or any Act or omission from my behalf.
(x)    I acknowledge that the Prize does not include any other component not detailed under Section (a) to Appendix A to the Term. Without derogating from the generality of the above, it is clarified and I acknowledge that the Prize does not include (1) flights or other transformations to and/or from one of the airports located in Paris, as shall be determined by the Organizer and/or the Prize Sponsor; and (2) any insurance – both to be obtained by me, at my responsibility and costs.
(xi) All rights, titles, and interests as well as any intellectual property rights, in and to my Answer to the Contest Question shall be owned solely and exclusively by the Organizer, as of the creation of such Answer to the Contest Question. 
(xii)    I hereby irrevocably grant  Organizer a fully paid-up, royalty-free, exclusive, sublicensable, worldwide, perpetual license to use: (1) my Answer to the Contest Question, and any modification thereto; and (2) my Participant Information, image, likeness, name and/or nickname – all as Organizer deems fit and for its own purposes, which shall include without limitation commercial use, make derivative work, reproduction and distribution on any media, including on social media (organic and sponsored), advertising, performance marketing, promotion, etc.. It is clarified that the Organizer shall have no obligation to perform any use of my Answer to the Contest Question and/or of my Participant Information image, likeness, name, and/or nickname and such use shall be made at the Organizer discretion. 
(xiii)    I am not:
(a)    any employee of Organizer and its relatives, Prize Sponsor and its relatives, and employees and relatives of any third-party agency contracted by Organizer or Prize Sponsor to execute any part of the Contest who (a) participated in any phase of Contest (definition, design, development, approval or execution); and/or (b) has or had access to confidential or privileged information about any phase of Contest (definition, design, development, approval or execution); 
(b)    Organizer’s Executive Management; and
(c)    Organizer´s employees in the marketing and credit cards (including its Information Area) who have the authority to make or ability to influence business decisions.

RWC TOURNAMENT COMPETITION TERMS AND CONDITIONS

 

 

In the event that the commercial stakeholder wishes to run competitions and/or prize draws (to win, for example, Match Tickets and/or commercial stakeholder Products or tournament experiences), the process set out in detail below must be adhered to. 

 

The commercial stakeholder shall be required to submit representative samples of artwork and competition and/or prize draw terms and conditions in accordance with the Brand Guidelines and substantially in the format set out in the pro forma terms and conditions set out below at least two (2) weeks prior to the launch date of the relevant competition. RWCL, or its representative, shall have two weeks in which to approve the submissions but RWCL shall use reasonable commercial endeavours to decrease such response time as may be reasonably required in exceptional circumstances.

 

As a material condition of this Agreement, the commercial stakeholder shall ensure that the process set out below is communicated to, and adhered to by, all of their Affiliated Companies, agencies, and representatives. Further, prior to submission, the commercial stakeholder shall have undertaken all necessary due diligence to ensure that the relevant competition complies with such laws and regulations as are applicable in the jurisdiction(s) in which the competition and/or prize draw is held, promoted, and/or staged.

 

 

Restrictions applicable to all competitions:

 

  • Auctions for match tickets (i.e. where tickets are potentially sold for more than their face value) are not permitted

  • Commercial raffles/draws to recover/profit on the face value of a match ticket are not permitted

  • Charity raffles where match tickets are donated as a prize are permitted as long as the cost of the raffle ticket does not exceed the face value of the match ticket price.

  • Free draws (e.g. where the consumer registers an email or leaves a business card) are permitted

 

 

MATCH TICKET INCLUSIVE COMPETITIONS

 

The commercial stakeholder is required to submit to the RWCL representative a copy of i) the creative which it proposes to disseminate in relation to the competition, and ii) the terms and conditions of the competition which must incorporate the terms set out below (which terms shall be stated to prevail over any other conflicting terms).  A variation to the terms and conditions below may be agreed by RWCL in exceptional circumstances (it being acknowledged that the commercial stakeholder may include additional terms and conditions in certain competitions where match tickets form part of a combined package prize (for example, combined with travel, hospitality, etc.), provided always that such additional terms and conditions do not conflict with the terms of these approved terms and conditions and provided that such prizes when combined with such other packages comply with the terms and conditions of this agreement).

 

Please note that these terms and conditions apply to competitions held in the UK and should be adjusted accordingly where competition is to be held in other jurisdictions.

 

Acceptance of the rules is a condition of entry and entry instructions form part of the rules.  Prior to the awarding of prizes, the winners shall be required to confirm acceptance of these terms and conditions.

TERMS AND CONDITIONS

 

  1. Each winner and his/her guest(s) as applicable agree to comply with the terms and conditions applicable to the issue and use of tickets from time to time (as available and set out at https://brand.rugbyworldcup.com/Brand/Ticketing/RWCL_StakeholderTicketingTCS.pdf or such other webpage as determined by Rugby World Cup Limited (“RWCL”) from time to time), the tournament organizer (Federation Francaise de Rugby 2023, “FFR2023”) and all applicable venue owner or operator rules and regulations to access Rugby World Cup venues and any other areas associated with Rugby World Cup (including any terms of accreditation determined by RWCL).  Further, each winner and his/her guest(s) acknowledge that he/she may be required to enter into a direct acknowledgment and/or agreement with RWCL and/or FFR2023 concerning the use of the tickets and compliance with ticket terms and conditions prior to receiving the prize.

 

  1. Winners and/or guests shall not, while using Rugby World Cup tickets, display or publicize any political slogans or homophobic language, images of a lewd or explicitly sexual nature, images containing logos of competitors and overt brand sponsorship or anything else deemed to ambush marketing or abuse of the Rugby World Cup, content which is defamatory, obscene, illegal, vulgar, offensive or otherwise unsuitable or infringes others’ rights (including intellectual property rights) or reflects negatively upon any of RWCL or the Rugby World Cup.  Each entrant agrees and acknowledges that any breach of the above (clause 2) will cause significant damage and loss to RWCL.

 

  1. The Promoter may pass personal information relating to prize winners to RWCL and/or FFR2023 (and any of their service providers or agents) for the purposes of monitoring the distribution and use of Rugby World Cup tickets and related experiences and, in the event of a suspect breach of any terms and conditions, rules or regulations or RWCL and/or FFR2023 relating to the use of such tickets and/or experiences, investigating and taking action against such winners.

 

  1. This promotion is run by the Promoter with the permission of RWCL.  Accordingly, the Promoter is responsible for the operation of and all matters and concerns relating to the promotion, not RWCL or any other persons involved in the staging of Rugby World Cup 2023 (including FFR2023) and World Rugby (formerly the International Rugby Board), all of whom shall not be responsible for or liable to entrants in any way whatsoever in connection with this promotion.

 

NON-MATCH TICKET COMPETITIONS

Where the competition prize is goods or services other than Match Tickets, the commercial stakeholder is required to submit to the RWCL representative a copy of i) the creative which it proposes to disseminate in relation to the competition, and ii) the terms and conditions of the competition which must include the following provision (N.B “Promoter” shall need to be defined as the commercial stakeholder save where RWCL gives prior written approval on a case by case basis for a third party to be the Promoter. In such circumstances the competition must be led by the commercial stakeholder):
